TERMS AND CONDITIONS OF SALE

These terms and conditions of sale ("Terms") govern sales made on the website https://ninidogshop.com (the "Site"). Any order placed on the Site implies unconditional acceptance of these Terms.

ARTICLE 2 – PRODUCTS
NiniDogShop sells pet accessories. The products offered are those featured on the Site on the day of consultation, subject to availability. Products indicated as "out of stock" cannot be ordered.
Photographs, descriptions, and product features are presented with the greatest possible accuracy. However, minor variations (particularly in shade related to screen display) may exist without affecting the essential characteristics of the products.
ARTICLE 3 – PRICING
Prices are displayed in the currency of the market from which the customer is browsing the Site: euros, US dollars, British pounds, Swiss francs, or Canadian dollars. They include all taxes where required by the regulations of the delivery country, and exclude shipping costs.
Shipping costs, as well as any applicable customs duties and import taxes, are indicated to the customer before final confirmation of the order. The currency and applicable amounts are those displayed on the checkout page at the time of confirmation.
NiniDogShop reserves the right to modify its prices at any time; products are billed at the rate in effect at the time the order is confirmed.
ARTICLE 4 – ORDERING
To place an order, the customer selects the products, adds them to the cart, and then confirms the order after reviewing the contents and providing a valid email address and delivery address. The sale is final upon confirmation of the order by email and receipt of payment.
NiniDogShop reserves the right to refuse or cancel any order for a legitimate reason, including: an existing dispute with the customer, non-payment, suspected fraud, or an obvious error regarding the price or availability of a product. If payment has already been processed, the customer will receive a full refund.
ARTICLE 5 – PAYMENT
Accepted payment methods include: credit card, Shop Pay, Apple Pay, and PayPal. The payment methods actually available will be displayed at checkout.
Payment is due immediately upon ordering. By providing payment details, the customer guarantees that they are authorized to use the chosen payment method and authorizes NiniDogShop to charge the order amount. Transactions are secure; NiniDogShop does not store customer banking data.
ARTICLE 6 – DELIVERY
Products are delivered to the address provided by the customer during the ordering process. It is the customer's responsibility to ensure this address is correct; any reshipment due to an erroneous address may be billed to the customer.
Estimated delivery times are indicated at the time of the order. Unless otherwise stated, delivery will take place no later than thirty (30) days following the order. If this timeframe is exceeded, the customer may cancel their order under the conditions provided by law and will be refunded.
In the event of a damaged or incomplete package, the customer is invited to note reservations with the carrier and contact NiniDogShop as soon as possible.
For deliveries to destinations outside the European Union, custom duties and import taxes are calculated and collected by NiniDogShop at the time of payment. The amount is shown to the customer before order confirmation. No additional amount is owed to the carrier upon receipt of the package.
ARTICLE 7 – RIGHT OF WITHDRAWAL
The customer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal without needing to provide a reason.
To exercise this right, the customer must inform NiniDogShop of their decision by email at contact@ninidogshop.com using an unambiguous statement or the model form below. The customer must then return the products in their original, complete condition no later than fourteen (14) days after communicating their decision. Return shipping costs are the responsibility of the customer.
NiniDogShop will refund all sums paid, including initial shipping costs (at the standard rate), no later than fourteen (14) days after being informed of the withdrawal. The refund may be deferred until the products are recovered or until proof of shipment is provided. The customer may be held liable for any depreciation of the products resulting from handling other than what is necessary to establish their nature and characteristics.
The right of withdrawal cannot be exercised for personalized products or items unsealed after delivery that cannot be returned for hygiene reasons.

ARTICLE 8 – LEGAL WARRANTIES
Independently of any commercial warranty, the customer benefits from:
– the legal warranty of conformity for two (2) years from delivery of the product, allowing them to obtain the repair or replacement of the non-compliant product, or failing that, a price reduction or a refund;
– the warranty against hidden defects, allowing them, in the event of a hidden defect rendering the product unfit for its intended use, to return it for a refund or keep it in exchange for a partial refund.
To invoke these warranties, the customer should contact NiniDogShop at contact@ninidogshop.com.
ARTICLE 9 – LIABILITY
NiniDogShop is automatically responsible for the proper execution of the distance contract. However, it cannot be held liable for the non-performance or improper performance of the contract attributable to the customer, an unpredictable and insurmountable event by a third party, or a case of force majeure.
NiniDogShop cannot be held liable for damages resulting from a use of the products that does not comply with their intended purpose or the instructions provided.
ARTICLE 10 – INTELLECTUAL PROPERTY
All content on the Site (images, texts, logos, documents, downloadable files, and any element contributing to its composition) is the property of NiniDogShop SAS or is used with permission. Any total or partial reproduction, representation, or exploitation without prior written consent is strictly prohibited.
ARTICLE 11 – PERSONAL DATA
Personal data collected during the order is necessary for processing the order and managing the customer relationship. It is processed in accordance with applicable data protection regulations. The customer has the right to access, rectify, erase, object to, and port their data, which can be exercised by contacting contact@ninidogshop.com. ARTICLE 12 – MEDIATION AND DISPUTE RESOLUTION
In accordance with article L612-1 of the French Consumer Code, the customer may use a consumer mediator free of charge in the event of a dispute that has not been resolved by a prior written complaint submitted to NiniDogShop SAS.

ARTICLE 13 – GOVERNING LAW
These Terms and Conditions of Sale are governed by French law. In the event of a dispute, and failing an amicable resolution or mediation, the French courts shall have jurisdiction under standard legal conditions.
ARTICLE 14 – SEVERABILITY
If any provision of these Terms and Conditions of Sale is declared null or unenforceable, the remaining provisions shall remain in full force and effect.
ARTICLE 15 – AMENDMENTS
These Terms and Conditions of Sale may be modified at any time, notably to remain compliant with the law. The applicable terms are those in effect on the date of the order. Users will be informed of substantial modifications by email or via a notice published on the Site.

Mobile Terms of Service

The Nini dog shop mobile message service (the "Service") is operated by NINIDOGSHOP SAS (“Nini dog shop”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Nini dog shop’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Nini dog shop through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Nini dog shop. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Ninidogshop or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Nini dog shop mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
